NOTICE OF YOUR FINANCIAL PRIVACY RIGHTS

 

At First Harrison Bank, the security of your information is extremely important to us.  This privacy notice sets forth First Harrison’s practices in relation to your private personal information.  It is our intent that you are aware of and comfortable with the way in which First Harrison administers and protects your private information.  Please allow the following question and answer format to serve as an overview of how your private information is handled and protected.

 

What sort of private information does First Harrison have about me?

*      Information you give us on applications or other forms

*      Records relating to your transactions with us

*      Information about your transactions with our affiliates

*      Information about your transactions with others (ex. checks you’ve written on a FHB checking account to a third party)

*      Information from a consumer reporting agency such as a credit bureau

*      Information we’ve received as a result of verifying customer information

 

How is this information used and to whom would it be disclosed?

First Harrison may disclose such information:

*      To fulfill requests that you have made (such as an application for a loan, or a request to supply credit or deposit verification information to a third party with whom you’re starting a relationship)

*      To our attorneys, accountants, auditors, or regulators in their ordinary performance of duties for or on behalf of the bank.

*      To consumer reporting agencies (such as credit bureaus).

*      In other circumstances as necessary and permissible by law.

 

In such circumstances, the following categories of information could be disclosed, as deemed necessary.

*      Name

*      Address

*      Account balances

*      Account activity

*      Types of accounts

*      Deposit or Payment history

*      Mortgage appraisals

 

Does First Harrison sell my information?

No.  We can’t emphasize that enough.  While many other banks play that game, First Harrison doesn’t do business that way.  Further, we WILL NOT disclose information about you to ANYONE except as disclosed in this policy or otherwise permitted or required by law.

 

What types of affiliates could have access to my information?

Affiliates are entities owned by First Harrison Bank, or are under a common control (controlled by the same entity) with First Harrison Bank, or whom own or control us.  Being a community bank, First Harrison’s affiliates are limited.  Bank records could be accessed by First Capital Inc, First Harrison’s holding company.  Representatives of First Harrison Financial Services, an investment wing of the bank, could have access to customer records in order to identify customers who would be benefited by those services.

 

Would non-affiliated third parties have access to my information?

No, except as disclosed in this notice and permitted by law.

 

Does First Harrison disclose information about former customers?

No, except as disclosed in this notice and permitted by law.

 

 

Does First Harrison use my information to market to me?

Yes, First Harrison does use information in it’s possession to notify you of products we offer which may be of interest to you, based upon the information we have on file.  We may from time to time use a marketing service to generate such marketing material to you.  In that case, such a service would have possession of general information such as your name and address.  In such a case, First Harrison would always contractually obligate such a third party to protect your information and use it for only the purposes directed by us.  In all cases, the use of your information to let you know of First Harrison products that could benefit you would be done in accordance with federal and state law.

 

Do I have the right to “opt out” of any of the information disclosure described in this notice?

Federal law outlines certain types of information sharing which are permissible, and those which are not, unless the consumer has been given a right to “opt out” of the sharing.  Caring for your information security, First Harrison elects to remain conservative and not engage in liberal information sharing practices which would require opt out notices.  Because First Harrison stays within these conservative information sharing practices, the answer is no, federal law does not give you the right to opt out of the sort of information sharing described in this notice.  However, should you request such an opt-out, First Harrison will take reasonable steps to accommodate your request, such as excluding you from marketing efforts.

 

How else does First Harrison ensure the confidentiality, security, and integrity of my information?

We restrict access to information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards to protect this information.  Information security and privacy audits are routinely conducted by internal and external auditors.

 

FCRA/FACTA Notice

 In accordance with the Fair and Accurate Credit Transactions Act of 2003, if you are indebted to the bank we must disclose to you that WE MAY REPORT INFORMATION ABOUT YOUR ACCOUNT TO CREDIT BUREAUS. LATE PAYMENTS, MISSED PAYMENTS, OR OTHER DEFAULTS ON YOUR ACCOUNT MAY BE REFLECTED IN YOUR CREDIT REPORT.
